States Want Autonomy

March 6, 2012

The National Conference of State Legislatures has been vocal over coming changes to the Wire Act of 1961. It has taken up opposition to the federal legalization of Internet poker, and has informed all congressional leaders that the decision should be left to individual States and handled at the state level.

Two influential state lawmakers sent a letter to the congressional leaders, discussing the new Department of Justice ruling last December, which stated that the Wire Act of 1961 should only be considered to apply to sports betting. It is inherently implied in this new ruling that interstate online gambling (except sports books) would now be legal on a National level.

It seems that there seems to be a fair level of contention over this new ruling. On one side of the fence there are those States which are happy to be able to nurture a profitable (from a taxation point of view); whilst others maintain that they do not want any form of online gambling within their boundaries. It is the latter kind which is opposed to Federal legislation, and who want the decision upon the legality of interstate online gambling to rest with them.

A direct quote from the letter sent explains things better, "States have long been able to choose whether or not other forms of gambling should be legal and have been very successful in its regulation. We also ask that the federal government respect the rights of states that choose to prohibit Internet gaming."

Although the actual legislation was designed to ease the problems faced by online poker players in the USA. Unfortunately, it was quite badly formed, which has introduced this new ambiguity in what used to be a water tight set of laws.

Regardless of the fact that the Department of Justice pushed through a badly drafted new legislation, and the individual States are divided upon the decision to allow or disallow online gambling within their borders, we think the bill is a good thing for us, the online gamblers. Playing online slots can be a fun pastime, of all forms of gambling it is possibly the least harmful, there can be no reason why backwards State officials do not allow their local residents to enjoy online slots.
